The Implications of Constitutional Court Decision No. 71/PUU-XX/2022 on the Registration of Interfaith Marriage in Indonesia

Abstract

This study aims to analyze the implications of Constitutional Court Decision No. 71/PUU-XX/2022 on the registration of interfaith marriages in Indonesia. The study is motivated by legal uncertainty surrounding the recognition of interfaith marriages, which creates administrative challenges and potential civil rights disputes. The research employs a qualitative descriptive normative approach, using document analysis, academic literature review, and examination of previous Constitutional Court decisions. Data were collected through literature studies and policy documentation, then analyzed systematically to understand the impact of the decision on marriage registration practices and emerging legal implications. The results indicate that the Constitutional Court decision confirms that interfaith marriages are only legally recognized if they comply with the religious law of each party, providing legal certainty for civil registry officials, religious institutions, and the couples involved. The decision affects procedural coordination between state and religious institutions, public legal education, and the need for official guidelines regarding interfaith marriage registration. Normative analysis emphasizes the importance of balancing adherence to religious norms and protection of individual rights in a pluralistic society. The study concludes that Constitutional Court Decision No. 71/PUU-XX/2022 opens opportunities for reformulating administrative procedures and policies to be more adaptive, ensuring that interfaith marriages are conducted fairly, accommodatingly, and with comprehensive legal protection. The findings are expected to inform policy improvement, legal education, and institutional coordination concerning interfaith marriage in Indonesia.
